Abilene Cotton Oil Co., 204 U.S. 426 , 27 S.Ct. 350 , 51 L.Ed. 553 (1907), the Court, despite the existence of a saving clause virtually identical to section 414, struck down a state common law cause of action challenging a rail carrier’s rate as “unjust and unreasonable.” The court did so because rate regulation was within the exclusive jurisdiction of the Interstate Commerce Commission, and a state court action “would be absolutely inconsistent with the provisions of the act.” Texas & Pacific *555 Railway, 204 U.S. at 446 , 27 S.Ct. at 358 .
